Fettspielen.de Licensing Terms and Conditions for the Licensing of Online Games
1.Scope of Contract
2.Usage Rights
  • 2.1.You grant Fettspielen.de a non-exclusive and sub licensable right to use the Online Game on the Fettspielen.de website and to allow its visitors to play the Online Game on the Fettspielen.de website. Above that you grant Fettspielen.de all necessary rights to allow Fettspielen.de to entitle its users to use the Online Game on their own website with respect to Clause 1.2.
  • 2.2.You acknowledge and agree that Fettspielen.de shall be entitled to display commercial ads at the beginning and at the end of the Online Game. Above that you acknowledge and agree, that Fettspielen.de shall be entitled to permanently display its and a Link to the Fettspielen.de website within the games in a well visible area of the game. You agree to support Fettspielen.de and provide all necessary technical details.
  • 2.3.All other rights and title in the Online Game remain with you. No other rights and title in the Online Game expect those mentioned in these Terms and Conditions shall be transferred.
  • 2.4.You warrant that you have all necessary rights and title in the Online Game to fulfil all your obligations resulting from these terms and conditions. You hold Fettspielen.de, it's officers, organs and employees harmless from and against any claims, damages, liabilities, costs and expenses arising from any breach or any alleged breach of your representations, warranties, or undertakings under this Agreement,provided
  • a)Fettspielen.de uses the Online Game in accordance with these terms and conditions,
  • b)Fettspielen.de immediately notifies you of any such claims and
  • c)Fettspielen.de offers you the opportunity to take over the lead of any such proceeding.
  • 2.5.The foregoing indemnification shall survive the termination of this agreement provided Fettspielen.de ceases to use the Online Game from the termination day on.
3.Warranties
  • 3.1.You warrant that the Online Game
  • a)does not contain pornographic or obscene material;
  • b)does not glorify war, terror or violence;
  • c)is not otherwise obviously qualified to heavily impact children or minors in their well-being;
  • d)does not present humans, that are dying or that suffer heavy physical or mental distresses in a way that harms human dignity without predominately and legitimate public interest;
  • e)does not suggest hate against parts of the population or against a national, race, religious or other group defined by their folklore, does not challenge violence or arbitrariness against them and does not attack human dignity by insulting, decrying or defaming parts of the population;
  • f)does not show cruel or otherwise inhuman violence against humans or animals in a way that expresses glorification or trivialization of such violence or that shows the cruelty or inhumanity in a way that harms human dignity;
  • g)is not qualified to defame, insult, threaten or slander other people; or
  • h)is not qualified to damage or harm the reputation of Fettspielen.de.
  • 3.2.Above that you warrant that during the term of this agreement only the version sponsored by Fettspielen.de – as described in clause 2.2 – will be offered to customers on any website. For the avoidance of doubt the the foregoing stipulation shall also be applicable in case you offer a version of the Online Game on your own website. In case of any breach of the foregoing stipulations you are obligated to immediately pay back Fettspielen.de any payments made by Fettspielen.de under clause 4 of this agreement.
4.Provisions of Fettspielen.de
  • In return to your provisions Fettspielen.de will pay you a one time fee that you and Fettspielen.de agreed upon. With payment of the foregoing one time fee all your claims and titles under this agreement shall be deemed compensated.
